Terms of Service
Last updated: [DATE]. These Terms apply to all use of PassGauge.
1. Who we are
PassGauge is operated by [COMPANY NAME], a [ENTITY TYPE] organized in [STATE] (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the PassGauge website and app (the “Service”). By creating an account or using the Service, you agree to these Terms; if you don’t agree to them, don’t use the Service.
2. What the Service is (and isn’t)
PassGauge provides practice questions, readiness tracking, and mock exams to help you prepare for electrician licensing exams. It is an independent study aid -- not an official study guide, and not affiliated with, endorsed by, or sponsored by the National Fire Protection Association (NFPA), PSI, the Texas Department of Licensing and Regulation (TDLR), or any state licensing board or exam vendor. NEC® and National Electrical Code® are registered trademarks of the NFPA; the Service cites NEC article numbers only and reproduces no NEC text. Performance on our practice material -- including passing any mock exam -- is not a prediction or guarantee that you will pass a real exam or obtain a license.
3. Accounts
Sign-in is passwordless: we email you a one-time magic link. You are responsible for keeping your email account and signed-in sessions secure, and for all activity that occurs under your account. If you lose access to the email address on your account, contact us at [SUPPORT_EMAIL].
4. Subscriptions & billing
Pro is a recurring monthly subscription billed in advance through Stripe, and it renews automatically until you cancel. You can cancel anytime from your account’s billing portal; cancellation takes effect at the end of the current billing period, and you keep Pro access until then. See our Refund Policy for refund terms.
5. Content accuracy & the changelog
Practice questions are produced through a mix of automated checks and, where noted, human subject-matter review, and every correction we make is recorded in our public changelog. We work to keep content accurate, but we don’t warrant that it is error-free or that it reflects the code edition and amendments currently adopted in your jurisdiction. The Service is exam preparation, not a code reference: always verify against the officially adopted code and your state board’s current requirements before relying on any answer for real-world work.
6. Acceptable use
Don’t scrape, copy, resell, or redistribute the question bank or any other part of the Service; don’t circumvent or attempt to circumvent rate limits, paywalls, or account restrictions; and don’t use the Service to violate any exam vendor’s test-security rules (for example, PSI’s).
7. Disclaimers & limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. [COMPANY NAME] IS NOT LIABLE FOR EXAM RESULTS OR LICENSING OUTCOMES, FOR DECISIONS MADE OR WORK PERFORMED IN RELIANCE ON THE SERVICE, OR FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS, TAKEN TOGETHER, WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS OR LIABILITY LIMITS, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.
8. Changes to these Terms
We may revise these Terms from time to time. Material changes will be posted here with a new “Last updated” date, and your continued use of the Service after a change takes effect means you accept the revised Terms.
9. Governing law
These Terms, and any dispute arising out of them or the Service, are governed by the laws of the State of [STATE], without regard to its conflict-of-laws rules.
